Why do we have an HOA and property manager?
The City of Frisco, through its Subdivision Ordinance, requires any developer of a subdivision that contains general common elements (e.g. monument signs, shared amenities, entrance landscaping, etc.) to form an HOA that complies with the requirements of the Ordinance. Mainvue developed the vision of this community, which is captured in the CC&Rs and Design Guidelines to be executed by the HOA in compliance with the Ordinance. The Property Manager serves as the agent for the HOA and manages the day-to-day operations of the association.

How is the HOA structured?
The HOA is not a monolith, it is made up of different interdependent entities:
Members – Each owner of a Lot (Homeowners).
Board of Directors – Responsible for the general governance and administration of the Association and its Declaration (Bylaws, CC&Rs, etc.)
Architectural Control Committee (ACC) – architectural review body for the Property.
Other Committees – as designated by the Board.
The Property Manager is a 3rd party professional services company, hired as the agent for the Association. The Property Manager interfaces with all entities of the HOA, and carries out the execution of the Declaration.
How can I support the HOA in becoming an agent of change? How do I join a Committee?
The best way to drive change is to get involved. Sign up for a committee, reach out to the board with your ideas and suggestions, run for a seat on the board. The more involved we are in shaping our community, the more we all benefit.
What are the official HOA communication channels? Does the HOA have a social media policy?
No, the HOA does not currently own or maintain any official social media channels. The HOA is unable to conduct matters of the association on social media, all official HOA communication is done via regular mail, e-mail, or telephone. Homeowners may self-organize a social media group for community development and networking purposes, but it is not monitored or considered official HOA communication. The HOA has no control of social media groups.
I have an idea, who do I talk to?
We welcome ideas and feedback from homeowners. An annual satisfaction survey is conducted by our Property Manager to gather input from the community. You may also find our contact details on this page.
What if I am unhappy and I don't know who to talk to about my grievances?
If you are unhappy with the way the Property Manager is addressing your concerns, please contact the Board through our official communication channels so we can have an opportunity to help you. You may find our contact details on this page. Be sure to participate in our annual satisfaction survey to make your opinions count, the best way to drive change is to get involved in the association.
Where do I pay my dues?
On TownSq. Please contact our property manager to obtain your account number, which is necessary to create an account.
How are my dues calculated? What is included in the dues?
Approximately 40% of your dues go toward common area landscaping, irrigation, and maintenance. 24% goes towards general and administrative expenses including property management. 13% goes towards common area utilities. 8% goes to insurance. The rest goes towards reserves as projected in the reserves study. Every homeowner dues are the same, as each homeowner holds an equal interest / membership % in the association. What happens if I don't pay my dues, or if I pay late?
Late dues and penalties can result in a lien being placed on your property, negative impact to your credit score, and at worst, your property being foreclosed. All attorney fees and collection costs become the responsibility of the delinquent homeowner. Moreover, your ability to refinance and/or sell gets impacted as well. Any lien holders on your mortgage (e.g. Bank) are also notified and can decide to pay on your behalf without your consent. If you are facing financial hardship, please contact the Property Manager to setup a payment plan and avoid your account from being flagged as delinquent.

Why do I need to get ACC approval for changes to the exterior of my home?
Mainvue developed a set of Design Guidelines that are to be followed by all homeowners. The ACC helps homeowners ensure their exterior modifications do not violate the design guidelines and result in unnecessary enforcement actions and fines by the Property Manager and the City. The ACC operates as an independent committee from the Board. The State of Texas grants these rights to the Association in the Texas Property Code.

Can I paint my house? Where do I find information about approved colors?
Mainvue developed a color scheme for the different home models in our community. Homeowners may not change the exterior colors of their home. Please contact the builder warranty division to get a copy of the color scheme for your home.
What happens if I don't seek ACC approval? What happens if I make an exterior modification without ACC approval?
When a homeowner makes an improvement or modification to the exterior of their property, and does not have an ACC approval on file, the Board is able to take enforcement actions as described in the CC&Rs and in the Texas Property Code, including but not limited to, legal action against the homeowner, referring the matter to the appropriate City of Frisco departments, and recovering all expenses involved in bringing a property back into compliance. It is for these reasons that is important for all homeowners to obtain ACC approval prior to making any exterior modifications. What happens when I don't agree with an ACC decision?
Homeowners may contact the Property Manager to request a Board hearing, where the homeowner can request an independent review of the matter by the Board, and/or request a variance to be considered. The Board is not able to intervene unless the homeowner follows this process as described in our CC&Rs.
Why do I get notices of violations? Am I being unfairly targeted by the HOA?
The Property Manager does regular drive-throughs of the neighborhood to check for compliance with our CC&Rs. This is part of their scope of work, and they are responsible for working with homeowners to "cure" any violations of our CC&Rs, and in more complex scenarios, working with outside parties like City of Frisco Code Enforcement. There is no such thing as "targeting", the property manager strictly follows our CC&Rs and guidelines.
What if I don't like the rules or don't agree with them?
The HOA or the Property Manager does not create the rules. These were created by Mainvue as part of their vision for our community. Each homeowner agreed to abide by these rules and regulations when they purchased a property in this community. The City also reserves the right to enforce the rules and issue fines. Think of your home as "product" that came with an associated set of terms and conditions that you checked off "I agree" when you clicked on the "buy now" button. That being said, the Declaration does allow for amendments to be done if certain criteria are met. More detailed information is available on the governing documents in your homeowner portal.
Why can't we abolish the HOA? Why can't we be self-managed?
This is not possible given the City of Frisco Subdivision Ordinance. If the HOA falls out of compliance with the Ordinance, the City will then start enforcement actions and levying fines to all homeowners. Prospective homeowners may have challenges seeking financing, and the community will become less attractive if it's in a state of disrepair.
Why is our community not gated?
Mainvue did not envision Fairwater to be a gated community. The Board has previously explored the possibility of doing this but it is extremely cost prohibitive, and the association would be responsible for maintaining the streets, sidewalks, and other items that are otherwise managed by the City of Frisco. That being said, we do have license plate scanners at both entrances for security purposes.
What areas are homeowners responsible to maintain?
Homeowners are responsible for maintaining the entirety of their lot, inclusive of all improvements, as described in the CC&Rs. This also includes your driveway(s), your portion of the sidewalk(s), and your portion of the parkway(s). The parkway is the grassy area between the sidewalk and the curb. Our CC&Rs include maintenance requirements such as:
Mowing, edging, and fertilizing your lawn and parkway area.
Pruning and trimming flower beds, shrubbery, trees, decorative grasses.
Replacing any dead landscaping.
Removing weeds and replacing mulch.
Cleaning your windows, concrete sidewalks, driveway, gutters, solar panels.
Repairing damaged trim, doors, windows, light fixtures, wall cladding, roof tiles, fence, mailbox.
Does the association maintain a list of approved vendors?
No. Currently the association does not endorse or recommend any particular vendors for homeowner maintenance. However, you may contact Associa to inquire about their Associa OnCall maintenance services that are provided to homeowners who are part of an Associa community.
Who maintains the roads, street lights and the rest of the sidewalks?
The City of Frisco is responsible for maintaining our roads, street lights, and common area sidewalks. Please access the myFrisco app to report any issues to the City of Frisco. Send a copy of your report to the Property Manager so they can follow up on your behalf.

The areas shaded in the following map are maintained by the HOA. The HOA does not maintain any individual homeowner lot or improvement(s).
